Formal Consultation Period for the Ardrossan (Transfer of Undertaking) Harbour Revision Order
HARBOURS ACT 1964 (AS AMENDED)
THE ARDROSSAN (TRANSFER OF UNDERTAKING) HARBOUR REVISION ORDER 202[ ]
- NOTICE IS HEREBY GIVEN THAT Ardrossan Harbour Company Limited, 16 Robertson Street, Glasgow G2 8DS (“the Applicant”) has applied to the Scottish Ministers for a Harbour Revision Order under section 14 of the Harbours Act 1964 (“the 1964 Act”).
- The Order will transfer the harbour undertaking at Ardrossan from the Applicant to Caledonian Maritime Assets Limited. As such, if the Order is made, Caledonian Maritime Assets Limited will become the statutory harbour authority for Ardrossan Harbour.
- Due to the nature of the HRO, an environmental statement is not required.
- Paragraph 16 of Schedule 3 to the 1964 Act (which requires information to be supplied concerning a project which is likely to have significant effects on the environment in Great Britain and in another European Economic Area State) does not apply to the application.
- A copy of the draft Order, may be inspected, free of charge, between the hours of 8:00AM to 5:00PM Monday to Saturday, at Caledonian MacBrayne, The Ferry Terminal, Ardrossan, KA22 8ED until the expiry of the forty-two day period from the date specified at the foot of this notice. The draft Order can also be accessed via https://www.cmassets.co.uk/ardrossan-legislation.
- Any person requiring further information concerning the proposed Order should apply in writing for that information to Ashfords LLP, Ashford House, Grenadier Road, Exeter, EX1 3LH quoting reference ‘The Ardrossan (Transfer of Undertaking) Harbour Revision Order 202[ ]’.
- Any person wishing to make an objection or representation to the Scottish Ministers concerning the application should write to Dario Dalla Costa, Ports Policy Advisor, Ports and Harbours Branch, Ferries Division, Transport Scotland, Area 2F North, Victoria Quay, Edinburgh EH6 6QQ or email harbourorders@transport.gov.scot within forty-two days from the date specified at the foot of this notice quoting ‘The Ardrossan (Transfer of Undertaking) Harbour Revision Order 202[ ]’ stating the grounds of their objection or representation and giving an address to which correspondence relating to the objection or representation may be sent.
- All objections or representations made, including personal information provided to Scottish Ministers, will be shared with the Applicant who may contact you to discuss your concerns. Names and the text of any representation may also be published on Transport Scotland’s website due to Freedom of Information requirements. If you wish to discuss any issues relating to the use of your personal data please contact the person specified in paragraph 7 of this notice.
- If an objection is duly made to the application and not withdrawn the Scottish Ministers may, before making their decision (i) cause an inquiry to be held, or (ii) give to the objector an opportunity of appearing before and being heard by a person appointed by them.
