Islay Vessels Naming Competition—Terms and Conditions

Due to a technical failure, the closing date of this competition has been extended to midnight on Friday 26th May 2023. This is to ensure the fairness of the competition.

The Promoter is Caledonian Maritime Assets Ltd, Municipal Buildings, Fore Street, Port Glasgow, PA14 5EQ.

Timing

The Promotion commences Monday 24th April 2023 and closes at midnight on Sunday 14th May 2023.

Eligibility

Entry is open to UK residents aged 18 and over. Directors, management and employees (and the immediate families of directors, management and employees) of the Promoter or the agencies or companies associated with this Promotion are not permitted to enter the Promotion.

How to enter

By submitting your entry to this Promotion, you agree to be bound by these Terms and Conditions. Entry instructions form part of these Terms and Conditions. Entries submitted with incomplete information, or found to contain invalid information, shall be deemed invalid entries. There is no payment required to enter.

To enter the Promotion you must:

  1. Visit the competition page at: https://www.cmassets.co.uk/name-new-islay-vessels/
  2. Follow the registration instructions
  3. Review the shortlist of six names (“Short List”) as selected by the Promoter
  4. Choose your two favourite names and click on them to mark them as the names you want to win
  5. Submit

In case of dispute, an entry will be regarded as made by the authorised account holder of the e-mail address submitted at the time of entry. “Authorised Account Holder” is defined as the natural person who is assigned to an e-mail address by an Internet Access Provider, online service provider, or other organisation (e.g. business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.

Automated entries are prohibited, and any use of such automated devices will cause disqualification. The Promoter and its agencies are not responsible for lost, late, or misdirected entries or transmissions, or problems of any kind whether mechanical, human or electronic. The Promoter does not warrant that the entry mechanism will be available at all times during the Promotion Period.

Entrants may only vote once from each email address registered. Entries submitted through an automated system are prohibited and ineligible to win. If an entrant submits the same entry more than once, the Promoter may block that entrant from submitting any further entries and the entrant will be ineligible to win the Prize.

The Promoter reserves the right to cancel, amend, terminate or temporarily suspend this competition at any time with no liability to any entrant or any third party.

Judging criteria

The six shortlisted names are being put to a public vote. Voting will be via the Promoter’s website – www.cmassets.co.uk. The two names that receive the highest number of votes, after independent verification, by the end of the Promotion Period shall be deemed to be the Winning Names and those names shall become the names of the two new ferries for Islay.

All entrants who take part in the Promotion by voting will be entered into a pool and one Overall Winner will be decided by means of a random draw conducted by an independent person to be held on Sunday 14th May 2023 (the “Draw”). That person will receive the Prize listed below.

The Winner will be notified of the fact that they have won within 5 days of the closing of the public vote by email.

The Promoter will use reasonable endeavours to contact the Winner using the contact details supplied upon entry to the Promotion. If the winner does not respond within one calendar month of the first notification, then the Winner forfeits the right to claim the Prize and the Promoter is free to nominate another winner.

Prizes

One (1) prize is available to be won:

One (1) Prize for the first name drawn at random on Sunday 14th May 2023:

  • One (1) return ticket for a car and up to four (4) passengers to be used on one of the new vessels

All elements of the prize are subject to terms and conditions as prescribed by the service providers.

No cash or alternative prizes are available, with the exception that in the event of circumstances outside of its control prizes as specified are not available; the Promoter reserves the right to award a similar prize of equal or greater value.

Limitation against liability

If for any reason any aspect of the Promotion does not function correctly, whether by means of infection by computer virus, network failure, bugs, tampering, unauthorised intervention, fraud, technical failures or any cause beyond the control of the Promoter that corrupts or affects the administration, integrity or fairness of the Promotion, then the Promoter may at its sole discretion cancel, modify or suspend the Promotion and/or invalidate affected entries.

The Promoter and its associated agencies and companies accept no liability for any loss, expense or damage which is suffered or sustained (whether or not arising from any person’s negligence) in connection with the Promotion and/or prize, other than such liability that cannot be excluded by law including death or personal injury caused by negligence, where liability shall be limited to the minimum permissible by law.

If there are reasonable grounds to believe that there has been a breach of these Terms and Conditions by an entrant, The Promoter may, at its sole discretion invalidate the relevant entry and disqualify the entrant from the Promotion, irrespective of the stage in the Promotion reached.

The Promoter’s decision in all matters relating to the Promotion is final and binding and no correspondence will be entered into.

Should you win, you may be requested to take part for free in any publicity for the Promotion as requested by the Promoter.
