Complete NTM 35/22

Mariners are informed this updated NTM covers the implementation of maritime sanctions at CMAL ports and harbours that were introduced by the UK Government on 1 March 2022, under the Russia (Sanctions) (EU Exit) (Amendment) (No. 4) Regulations 2022, which amend the Russia (Sanctions) (EU Exit) Regulations 2019, and subsequent maritime sanctions implemented against Belarus that were introduced on 5 July 2022 by the Republic of Belarus (Sanctions) (EU Exit) (Amendment) Regulations 2022. These regulations amend the Republic of Belarus (Sanctions) (EU Exit) Regulations 2019.

The Russia Regulations and the Belarus Regulations are collectively referred to herein as “the Regulations”.

Until further notice, any ships linked to Russia or Belarus caught by the Regulations will not be given permission to enter or access any CMAL ports and harbours (full list here), where it is known or there is reasonable cause to suspect, that the ship is –

  1. a ship owned, controlled, chartered or operated by a designated person,
  2. a ship owned, controlled, chartered or operated by persons connected with Russia or Belarus,
  3. a ship flying the flag of Russia or Belarus,
  4. a ship registered in Russia or Belarus, or
  5. a specified ship.

Exceptions to these restrictions may be granted only in case of emergency, which includes threats to safety or serious harm to the maritime environment.

Ships / ship agents hold vital information which will assist to ensure that the Regulations are not breached. All ships / ship agents will be contacted and required to provide such information as is necessary before a ship may enter any CMAL port. As part of that communication, ships / ship agents will be required to confirm that they are not linked to Russia or Belarus.

Open port access to all CMAL ports, harbours and facilities remains open to all other ships that are not caught by the Regulations, but access will not be granted whilst checks are being undertaken to ensure in-so-far as is possible that a ship is not caught by the Regulations.
